Rental Agreement 1. Parties. Property. Landlord hereby lets the following property to Tenant for the term of this Agreement: (a) the real property known as, Four Bedroom Villa located in Crown Pointe Naples, Florida; and (b) the furniture and appliances on said property. Additional Services: Swimming Pool/Spa Heat. Landlord WILL Provide Swimming Pool and Spa Heating. Bicycles. Landlord WILL NOT Provide Bicycles for tenants use. 3. Term. This agreement shall run from 04-Nov-2010 to 13-Nov-2010 (9 nights). Check in is at 3 PM 04-Nov-2010. Check out is at 10 AM 13-Nov-2010. 4. Rent. The rental for said property shall be $2,132 and (it includes the $500 refundable breakage deposit and the PayPal 3.9% Charge). Payment $653 due with this agreement and the balance of $1,479 due on or before 16-Sep-2010. 5. Utilities. Landlord agrees to furnish the utilities. In Addition It Is Agreed: 1. Tenants shall not lease, sublease, or assign the premises nor house any additional persons without the prior written consent of the Landlord. 2. Tenant agrees that only the above listed persons shall occupy the premises and shall keep the same in good condition, free of damage or breakage (reasonable wear and tear excepted), and shall not make any alterations thereon without the written consent of the Landlord. 3. Tenant agrees that there is absolutely no smoking inside the apartment. 4. No pets of any kind are allowed. 5. Tenant agrees not to use the premises is such a manner as to disturb the peace and quiet of other tenants in the community. Tenant further agrees not to maintain a public nuisance and not to conduct business or commercial activities on the premises. 6. Landlord may enter the premises at reasonable times for the purposes of inspection, maintenance, or repair. In all instances, except those of emergency or abandonment, the Landlord shall give Tenant reasonable notice (at least one day) prior to such entry. 7. Tenant shall, upon termination of this Agreement, vacate and return the dwelling in the same condition that it was received free of damage or breakage. 8. In a dispute between the Landlord and Tenant which gives rise to any action in court, the losing party will pay the court costs and reasonable attorney fees of the successful party. I THE UNDERSIGNED AGREE TO AND HOLD HARMLESS THE DOS SANTOS FAMILY AND THEIR HEIRS, ESTATE, GUARTDIANS, AND/OR LEGAL REPRESENTATIVES, EMPLOYEES, AGENTS, AND REPRESENTATIVES FOR ANY ACCIDENT, INJURY, ILLNESS, DEATH, LOSS, THEFT, DAMAGE TO PERSON OR PROPERTY, OR OTHER CONSEQUENCES SUFFERED BY ME OR OTHER MEMEBERS OF MY PARTY ARISING OR RESULTING DIRECTLY OR INDIRECTLY FROM THE USE OF ALL PREMISES, EQUIPEMT OR SERVICES PROVIDED DURING MY STAY.
